The questions here involved were raised by defendant’s affidavit of defense raising questions of law to plaintiff’s amended statement of claim. The plaintiff, before the institution of this action, became, and still is receiver of Farmers and Mechanics Bank of Northumberland, Northumberland County, Pennsylvania, which was a State bank incorporated under the Banking Act of May 13, 1876, P.
