Writ of Error to the Circuit Court for Leon county. Section 15 of Chapter 1628, McClellan’s Digest, page 628, is as follows: “If for any cause the whole number of any grand or petit jury should fail to be summoned, the Judge of the court may direct the clerk to draw grand and petit jurors, and issue a venire to the sheriff or other officer directing him forthwith to summon a sufficient number for such grand and petit juries.”

The record in this case shows that on the 21st day of November, A.
