Appeal from a judgment of the County Court of Schoharie County (Bartlett III, J.), rendered January 13, 2003, upon a verdict convicting defendant of the crime of murder in the second degree.

Defendant was charged with murder in the second degree, arising out of an incident on August 11, 2001 where he shot the victim in the abdomen during an altercation on defendant’s front lawn.
