— Appeal by defendant from a judgment of the Supreme Court, Queens County (Browne, J.), rendered November 30, 1979, convicting him of rape in the first degree, sodomy in the first degree (two counts) and endangering the welfare of a child (two counts), upon a jury verdict, and imposing sentence. Judgment reversed, on the law, and new trial ordered. The facts have been considered and have been determined to be established.
