Appeal from a judgment of the Supreme Court (Pritzker, J.), entered April 5, 2010 in Washington County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

In 1995, petitioner was convicted of six counts of murder in *1556the second degree and was sentenced to an aggregate term of 30 years to life in prison. His convictions were subsequently upheld on appeal (People v Lopez, 262 AD2d 109 [1999], lv denied 93 NY2d 1003 [1999]) and his CPL article 440 motion was denied, as was his application for federal habeas corpus…
