Appeal from an order of the Supreme Court (Malone, Jr., J.), entered December 30, 2004 in Albany County, which, inter alia, granted a cross motion by defendant Service-Universal Distributors, Inc. to dismiss the complaint against it.

Plaintiff, a retail wine and liquor store, commenced this action asserting eight causes of action against defendant Service-Universal Distributors, Inc.
