This case was before the court at the October term, 1895, on the appeal of the ¿Etna Iron Works et al. v. Charles S. Owen. Appellant's claim, with others involved in the suit, was considered, and the court reversed the decree of the Circuit Court, and by its mandate directed as follows : “ Therefore it is considered by the court that for that error, and others in the record and proceedings aforesaid, the decree of the Circuit Court of Cook County in this behalf rendered, be reversed, annulled, set aside and wholly for nothing…
