This products liability action comes to the court under its diversity jurisdiction. Plaintiffs, Jan W. Buettgen and his wife, Elisa Buettgen, are Texas residents. On May 8, 1975, they bought a 1974 Volkswagen van, serial no. 2242061684, from defendant Transworld Volkswagen, Inc. (Transworld), a Michigan corporation, in Benton Harbor, Michigan. The van allegedly was designed and manufactured by defendant Volkswagenwerk, A.G. (VW Werk), a German corporation, and distributed in Michigan by defendant Volkswagen of America, Inc.
