Reversing.

The appellant, Frank Elliott, was arrested under a warrant issued by the county judge of McCracken county, charging him with the offense of unlawfully possessing spirituous and intoxicating liquors. Upon his trial before the officer who issued the warrant he was convicted and appealed to the McCracken circuit court with a like result, and from the judgment therein he prosecutes this appeal.
