Statement of the Case.

MONROE, J.

Plaintiff seeks to compel defendant to accept title to certain real estate, in accordance with a written agreement between them. The defense is that the title tendered is bad, or, if not bad, suggestive of litigation. This defense is founded on the following facts, to wit: The property was acquired on May 6, 1S97, by Mrs. Theresa Blaise, wife of George Digby, by an act which recites that the purchase is made with her paraphernal funds.
