The defendant” appeals from a conviction and sentence to the penitentiary for the crime of assault by willfully shooting at. The information was filed on October 19, 1925, and charges that the offense was committed on or about August 15, 1898.

In order to justify the prosecution, and to show that the offense had not prescribed, the information alleged that the commission of the offense was not brought to the knowledge of any officer of the state authorized and empowered to institute or direct prosecution until within the year immediately preceding the filing of the information, and further…
