The Lilley Coal & Coke Company, appellant, with a view' to the development of its coal mines determined upon the construction of two slopes from the surface to the coal, and to this end caused plans and specifications to be made of the proposed work, and invited bids therefor. A copy of these plans and specifications was furnished to appellee, whose business was that of general *412contractor.
