Pleasant M. Compton commenced an action for the recovery of lot of land No. 123, in the 8th district, second section of originally Cherokee, now Fannin county, against James M. Cassada, the tenant in possession, pending which, Cassada filed a bill in equity to enjoin said action for relief against the same, in which he alleged that Compton, one Russell Cannon and John Jones, granted this lot, with others, in partnership, the grant to which was taken out in the name of Compton.
