My consideration of this case brings me to these conclusions: (1) The issuance and service of process on two adult near relations were jurisdictional requisites. (2) Such jurisdictional requisites could not be dispensed with. (3) There was no provision of law for ex parte proceedings. (4) The law governing the removal of disabilities of minority and the sale of property of minors, under Section 419, Code of 1942, represent distinct legislative philosophies, and should not be confused.
