On October 22, 1958, defendants in error, Dr. Harrell E. Garrison, N. N. Duncan, Leon R. Daniel, James M. Hicks and A. L. Dickerson, Jr., hereafter referred to as “Trustees”, executed an instrument denominated “Declaration of Trust”, hereafter referred to as “Indenture”.
