—Order, Supreme Court, Bronx County (Phylis Skloot Bamberger, J.), entered on *135or about September 1, 1999, which denied defendant’s motion made pursuant to CPL 440.10 to vacate a judgment of the same court and Justice, rendered February 26, 1998, convicting him, after a jury trial, of murder in the second degree and criminal possession of a weapon in the second degree, unanimously affirmed.

The court properly denied defendant’s motion to vacate judgment without a hearing. Defendant offered no evidence that a witness at his trial received any promise or understanding regarding lenient treatment…
