On February 2, 1998, the plaintiff, Derek Dujanovic, filed a class action complaint commencing this action against MortgageAmeri-ca, Inc. (“MortgageAmerica”), a company in the business of extending mortgage credit. A motion for class certification was subsequently filed and the Court conducted a hearing on plaintiffs request for class certification on December 11, 1998.
