OPINION

HAYDEN, District Judge.

I. INTRODUCTION

On June 27, 2006, plaintiff Sean E.M. Hotung (“plaintiff’) commenced an in rem action against the defendant “cargo of a crate containing nine boxes of documents shipped aboard the M/V Hanjin Nagoya under bill of lading no. HK206003003 dated May 14, 2006” (hereafter, “cargo”) by filing a verified complaint’ 1 in this Court, invoking this Court’s admiralty and maritime jurisdiction under 28 U.S.C. § 1333.
