Kay Lambert and "W. E. Morton were opposing candidates for the office of sheriff of Nicholas county at the regular election in 1928. After the returns were canvassed, Lambert demanded a recount. In order to facilitate the recount, it was agreed between the candidates that in ease either one questioned the manner in which the canvassing board proposed to count any particular ballot it should be laid aside until all the unquestioned ballots were counted, and then the disputed ballots should be taken up and disposed of.
