BRIGHT, District Judge.

On or about September 25, 1942, libellant was requested by the respondent to assist the latter’s steamship Philip Schuyler, from Pier 9 West Shore, New Jersey, to Pier 14, Hoboken, New Jersey, the vessel to use her own propelling power, under an agreement which provided, among other things, that when the captain of any tug furnished by libellant or engaged in such assistance, or any other licensed pilot, goes on board the vessel, it would be understood that such captain or pilot became the servant of the owner of the vessel, assisted in respect to the giving of orders…
