NATURE AND HISTORY OF THE CASE

This is an appeal from an order of the court dated August 19, 1994 granting the Commonwealth parties’ motions for judgment notwithstanding the verdict.

*156The history of the cases is as follows. Johnson brought an action against the Commonwealth parties for wrongful death and survival arising out of the death of her husband, Steven Johnson. Barr brought an action against the Commonwealth parties for personal injury. Both cases arose out of the same incident, a motor vehicle accident.
