BROOKS, Judge.

Appellant was convicted of the murder of R. M. Glover, sheriff of Gonzales County, and his punishment assessed at con finement in the penitentiary for life. The killing occurred on June 14, 1901. Two days prior thereto appellant killed Morris, sheriff of Karnes County, in Karnes County. At the time Sheriff Morris was killer!, Sheriff Glover was in Cuero, De Witt County. Glover proceeded with a deputy sheriff of De Witt County to Kennedy, in Karnes County, and there for the first time learned that appellant was the man who had killed Sheriff Morris.
