SUMMARY JUDGMENT AND OPINION

KILKENNY, District Judge:

This matter is before the Court on the defendants’ motion to dismiss or, in the alternative, for a summary judgment in defendants’ favor.

*261Plaintiff, a citizen of Canada, filed this action against the above named defendants in the capacities as stated, claiming to be the pretermitted child of the decedent, Andrew Frank Lowes. The estate of Andrew Frank Lowes, deceased, was closed in January, 1966. Defendant, First National Bank of Oregon, is no longer executor of such estate.
