(dissenting) : I thoroughly agree with the dissent of Mr. Justice Watts, in this case; but owing to the great importance of the issue involved, I will to some extent elaborate my very pronounced convictions in the matter, with little expectation that any strength will be added to what he has so well said.

The facts are these: In February, 1917, Sullivan was under indictment in the Court of General Sessions for Charleston County, for a violation of the prohibition laws of the State then in force. Upon his trial he entered a plea of guilty, and was sentenced by the presiding Judge, Hon. I. W.…
