I. INTRODUCTION

In 2008, the New Jersey Department of Environmental Protection (“NJDEP”) filed its Third Amended Complaint (“TAC”) against various corporations for their use and handling of the gasoline additive methyl tertiary butyl ether (“MTBE”). The TAC includes claims of: strict liability based on defective design; public nuisance; strict liability under N.J. Stat. Ann. 58:10-23.11 to -23.24; strict liability under N.J. Stat.
