CHRISTIAN, Judge.
The offense is murder; the punishment, confinement in the penitentiary for five years.
It was charged in the indictment, in substance, that appellant, with malice aforethought, killed O. 0. Tipton by shooting him with a gun.
The homicide occurred at the home of deceased on the 10th of September, 1934. The State’s testimony was, in substance, as follows: Mrs. Lucy Price kept house for deceased.
