1Opinion of the CourtDowney, J.
Juday sued Barnett, Haggerty, and Reeve upon the following promissory note:
“$200. Ligonier, Ind., January 27th, 1869.
“ Six months after date, we promise to pay to the order of George W. Juday two hundred dollars, value received, without any relief whatever from valuation or appraisement laws, with ten per cent, interest.
“Thomas Barnett & Co.
“Edwin Reeve.”
To the complaint upon this note the defendants pleaded that on the 21st day of December, 1869, before George W. Alford, Esq., a justice of the peace of, etc., the above named *87plaintiff recovered a judgment against the above named defendants,…
