STRANAHAN, P. J.,

This court has before it a motion for a summary judgment in which defendant, The Bell Telephone Company of Pennsylvania, has asked that a summary judgment be entered in its favor and against Dan W. Jones, under the authority of rule 1035 of the Pennsylvania Rules of Civil Procedure, which provides that a summary judgment may be entered if there is no genuine issue as to any material fact, and that the moving party is entitled to a judgment as a matter of law.
