This action was commenced by the city of Milwaukee, in the municipal comt of that city, to recover a penalty for the violation of a city ordinance, prescribing the manner and place of weighing and selling hay within the city limits. The appellant admitted that he sold the hay within the'.limits of the 7th ward of the city, and that he refused to have it weighed upon the city hay-scales proper, and pay the fee imposed’ by the ordinance for weighing the same.
