This appeal comes to this court on questions of law from a judgment entered against the defendant in the Common Pleas Court of Cuyahoga County. The plaintiff was a passenger in an automobile then being driven by her husband in a northerly direction on East 105th Street in the City of Cleveland at about 2:30 A.M. March 16, 1952.
