The plaintiff brought an action in the Superior Court of Gwinnett County to enjoin the defendants as individuals and as deacons of Ewing’s Chapel' — an unincorporated Baptist church — from trespassing upon a described acre of land, and for general relief. Answering the petition, the defendants denied that they were trespassers and averred' that the church, in which they had membership and of which they were deacons, owned the land involved and was using it for cemetery purposes.
