The present case discloses a proceeding commenced before two justices of the‘peace, by a purchaser at sheriff’s sale, under the provisions of the act of 1836, to obtain possession of the land purchased by him. ,The person in possession made the oath prescribed by the statute, and the proceeding was transferred to the Common Pleas, according to the provisions of the act.
