MEMORANDUM DECISION AND ORDER
ROBINSON, District Judge.
I. BACKGROUND:
The United States of America (the “Government”) commenced the instant action on or about February 24, 2003, by the filing of a complaint (the “Complaint”) and a notice of pendency (the “Notice of Pen- dency”), in order to collect certain monies owed by .Constance Paugh (“Ms. Paugh”) pursuant to a certain promissory note and mortgage.
