(dissenting and concurring) : Action upon a policy of insurance in the sum of $5,000.00, upon the life of Robert W. Beaty, payable to his estate, issued October 30, 1925; his death in an automobile accident occurred on June 14, 1926. The policy called for a premium of $18.00 per quarter, payable in advance on or before the 1st days of March, June, September, and December of each year.

The insured paid no premium at all on the policy. When it was issued to him he stated to defendant’s agent, W. A. Holt, that he was in financial straits, and Holt advanced the money to pay the premium from…
