This is a proceeding, under the Uniform Declaratory Judgments Act of June 18, 1923, P. L. 840, wherein, upon petition of two persons, a nephew and a niece of Elizabeth Brown, deceased (hereinafter called the testatrix), the disposition of her residuary estate, covered by the 11th paragraph of her will, was declared invalid by the court below, as transgressing the rule against perpetuities.
