Hart, C. J.,

(after stating the facts). In the first place, counsel for appellees claim that the interest created by the leases which were assigned by Oonyers and Hunt to Henry did not create such an interest in lands as would support ejectment against the lessees by their assignee. This question was discussed and decided on the first appeal. The court said that an -action of ejectment -might be maintained in this. State in all cases where there is a legal right of possession against one who wrongfully holds possession from the person having the legal right.
