1. The executors of the estate of Charles Heber, deceased, filed objections in the county court to the allowance of the claim filed by his son, Carl Heber. They also interposed a counterclaim for the value of certain personal property alleged to have been owned by the decedent at the time of his death and thereafter converted by the claimant. The tort was expressly waived, and the executors stated in *475their counterclaim that they would rely upon an implied contract to pay what the property was reasonably worth.
