OPINION ON APPELLANT’S PETITION FOR DISCRETIONARY REVIEW
WHITE, Judge.
Appellant was convicted by a jury of rape. Punishment was assessed by the jury at nine years in the Texas Department of Corrections. On direct appeal, the First Court of Appeals reversed the appellant’s conviction and remanded the case to the trial court. The Court of Appeals said it was error for the State to inquire into the marital status of appellant’s co-defendant. Aguilar v.
