This action was brought in the Circuit Court of Lee county by Martha Sehneller against M. D. Kelly and Newton Alvis, to recover damages caused, as alleged, by the joint negligence of the defendants.
The declaration has but one count, which upon demurrer thereto, the trial court held to be a good declaration. The declaration alleges, in substance, that on the 16th day of July, 1922, the defendants and each of them were the owners and operators of certain automobiles, respectively, which they were then using and operating on the public road leading from the town of Jonesville to the town of Ben…
