—In an action to recover damages for personal injuries, the defendants Hudson River Petroleum Corp. and LakelandMerit-Armstrong, Inc., appeal from an order of the Supreme Court, Westchester County (Coppola, J.), entered September 20, 1999, which granted that branch of the plaintiffs motion which was for partial summary judgment on the issue of liability on the first cause of action alleging a violation of Labor Law § 240 (1) insofar as asserted against them, and denied their cross motion for summary judgment dismissing the first cause of action, the second cause of action alleging common-law…
