DOMENGEAUX, Judge.
This is an action by a surviving widow to recover, out of the estate of her deceased husband, the “marital fourth”, in usufruct only, under the provisions of Art. 2382 of the Louisiana Civil Code.
Dan S. Henry died testate on April 16, 1966, survived by his wife, Mrs. June W. Henry and three minor daughters. In his last will and testament Dan Henry pro- ' vided essentially that on his death:(a) the “June W.
