This is a suit brought to review the decision of the Commissioner of Internal Revenue, refusing plaintiff’s application for a permit to manufac*291ture ginger bitters extract for flavoring purposes, and to use whisky in the manufacture thereof. The application states that the preparation contains only sufficient alcohol to hold it in solution, and that it is a bona fide preparation, unfit for use as a beverage, and is not to be sold or used as a beverage, and that it is for sale as. such to manufacturers of soft drinks and like manufacturers for subsequent use in flavoring…
