The state appeals from an order of the circuit court allowing defendant’s motion to suppress LSD pills found in defendant’s jacket at the time he was booked into the Prineville city jail. Defendant was arrested for driving under the influence of intoxicants and was taken into custody. Defendant conceded at the hearing on his motion to suppress that there was probable cause to make the arrest. Following his arrest, defendant was placed in a detention cell pending the booking process.
