This is a' suit to enforce a local assessment for sidewalk paving and curbing.
After the rehearing was granted in this case, the appellee moved for a dismissal of the appeal, for want of jurisdiction of the matter in contest.
[1] The amount sued for is less than $2,-000; that is, below the lower limit of our jurisdiction in ordinary cases. The appeal was brought to this court, however, on the theory that a local assessment or forced contribution for street paving is a tax, within the meaning of the provision in article 85 of the Constitution that the…
