Error to Marquette. (Grant, J.) Debt for statutory penalty. Defendant brings error. The facts are stated in the opinion.

This is an action brought by the plaintiff to recover of the defendant the penalty provided by statute in a case where the railroad company refuses to transport a passenger over its road without legal and just cause.

How. Stat. § 3324, contains the provision which it is claimed furnishes the plaintiff with the foundation for her claim, and reads as follows:

**Every such corporation shall furnish sufficient accommodation for the transportation of all such passengers and property as shall, within a reasonable time previous thereto, offer -or be offered for transportation at the place of starting,…
