This matter comes before the Court upon remand from the Temporary Emergency Court of Appeals (TECA) for consideration of a claim by Eastern Air Lines, Inc. (“Eastern”) for price discrimination under § 210(a) of the Economic Stabilization Act of 1970 (the “ESA”), see 12 U.S.C. § 1904 note, as incorporated into the Emergency Petroleum Allocation Act of 1973 (the “EPAA”), see 15 U.S.C. §§ 751-757.
