Error to the Court of Civil Appeals for the Fourth District, in an appeal from Bexar County. Deutschmann sued Bussell, Simmons, and the Irrigation Co., andr had judgment against the latter, which appealed, resulting in a modification and affirmance of the judgment. The Irrigation Co. thereupon obtained writ of error. The judgment was ordered reversed and the cause remanded on November 27, 1907, in an opinion of the court pronounced by Mr. Chief Justice Gaines.

Selig Duetschmann instituted this suit in the District Court of Bexar County, in the city of San Antonio, against the San Antonio Irrigation Company, B. H. Bussell, J. A. Simmons, and Wm. McKenzie, to recover of them one-third of the irrigation plant and in the alternative the value of one-third interest in a franchise which was granted by the city of San Antonio to Simmons and Bussell and their associates, which franchise was transferred by Simmons and Bussell to the Irrigation Company without the consent of Deutschmann.
