This case comes here on writ of error. The plaintiff below brought an action in the circuit court of the fourth circuit against the defendant below on an instrument in writing, described in the complaint as follows:

“Know all Men by these Presents: That I, John Bargas, of Laupahoehoe, North Hilo, County and Territory of Hawaii, am held and firmly bound unto Roberto Ortiz, of Honomu, Hilo, Hawaii, T. H. in the sum of six hundred dollars, lawful money of the United States of America, to be paid to the said Roberto Ortiz, his executors, administrators, or assigns,…
