This case arises out of an altercation at Hardee’s Restaurant in *871Dublin, operated by defendant Franchise Enterprises, Inc. Plaintiffs Ronnie and Janice Gay are husband and wife. According to the evidence of record, on the evening of October 21, 1987 they went inside the restaurant, placed an order at the counter and sat at a table in the dining area of the restaurant while they waited for their order to be prepared. A group of young men sitting near them were talking loudly and using profanity and Mr. Gay asked them to “watch [their] language.” The young men became even louder and…
