Introduction

Commonwealth Land Title Insurance Company (“Commonwealth”) brought this action seeking a declaratory judgment that a title insurance policy issued by Commonwealth to IDC Properties, Inc. (“IDC”) affords no coverage to IDC’s loss of development rights in portions of the Goat Island South Condominium complex in Newport, RI. IDC has filed counterclaims against Commonwealth for bad faith denial of coverage.
